These Terms of Service ("Terms") govern your access to and use of the Sigh mobile application, website, smart vaping device, and related products and services (collectively, the "Services").

By creating an account, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.

1. Who We Are

Throughout these Terms, "Sigh", "we", "our", and "us" refer to Sigh Ltd.

2. Eligibility

You must:

  • Be at least 18 years old;

  • Have the legal capacity to enter into these Terms;

  • Comply with all applicable laws and regulations when using the Services.

The Services are intended solely for adults.

3. Important Health Information

Sigh is a behavioural change platform designed to support vaping reduction and habit awareness.

Sigh does not provide:

  • Medical advice;

  • Clinical diagnosis;

  • Treatment of any disease or medical condition;

  • Emergency support;

  • Mental health crisis services.

The information provided through the Services is educational and behavioural in nature and should not be relied upon as medical advice.

You should seek advice from a qualified healthcare professional regarding any medical concerns.

4. No Guarantee of Outcomes

Behaviour change is highly individual.

Although Sigh is designed using evidence-based behavioural principles, we do not guarantee that you will:

  • Reduce vaping;

  • Quit vaping;

  • Achieve any particular health outcome;

  • Avoid relapse.

Your use of the Services is at your own discretion and risk.

5. Your Account

You are responsible for:

  • Maintaining the confidentiality of your login credentials;

  • All activities conducted under your account;

  • Providing accurate and up-to-date information.

You must notify us immediately if you believe your account has been compromised.

6. The Sigh Device

The Sigh device includes behavioural features designed to support vaping reduction, including usage tracking and lockout functionality.

You acknowledge that:

  • Device limits are intentionally designed to create friction and support behaviour change;

  • Lockouts may temporarily prevent access to the device;

  • Device functionality depends on proper use and may be affected by hardware limitations, connectivity issues, software updates, or other circumstances outside our reasonable control.

You remain responsible for your decisions regarding nicotine consumption and use of alternative products.

7. Subscription Services

Certain features of the Services require a paid subscription.

Current pricing:

  • App Subscription: £4.99 per month

  • Starter Kit: £59.00, including:

    • One Sigh smart vape;

    • Four pods;

    • One month of app access.

Subscription fees are billed in advance and may automatically renew unless cancelled.

Prices may change from time to time. We will provide reasonable notice of any material pricing changes.

8. Cancellation

You may cancel your subscription at any time.

Cancellation will prevent future billing but will not ordinarily result in refunds for the current billing period except where required by law.

Deleting the app does not automatically cancel your subscription.

9. User Conduct

You agree not to:

  • Use the Services unlawfully;

  • Circumvent device restrictions or lockout mechanisms;

  • Interfere with or disrupt the Services;

  • Attempt to reverse engineer the software or device;

  • Upload malicious code;

  • Use the Services in any manner that could harm Sigh or other users.

We reserve the right to suspend or terminate accounts that breach these Terms.

10. Intellectual Property

All intellectual property rights in the Services, including:

  • Software;

  • Device designs;

  • Trademarks;

  • Branding;

  • Logos;

  • Content;

  • Graphics;

  • Features;

  • Algorithms;

  • Data compilations;

are owned by or licensed to Sigh Ltd.

Nothing in these Terms transfers ownership of any intellectual property rights to you.

11. Privacy and Data

Your use of the Services is also governed by our Privacy Policy.

By using the Services, you acknowledge that we may collect and process information necessary to:

  • Provide the Services;

  • Monitor device usage;

  • Improve product functionality;

  • Generate anonymised insights and analytics;

  • Comply with legal obligations.

We process personal information in accordance with applicable data protection laws.

12. Availability of Services

We aim to provide uninterrupted access to the Services but do not guarantee that the Services will always be available.

We may:

  • Modify features;

  • Suspend services;

  • Release updates;

  • Carry out maintenance;

  • Discontinue aspects of the Services.

Where reasonably possible, we will provide notice of significant changes.

13. Limitation of Liability

To the fullest extent permitted by law, Sigh shall not be liable for:

  • Indirect losses;

  • Consequential losses;

  • Loss of profits;

  • Loss of business opportunities;

  • Loss of data;

  • Loss arising from reliance on information provided through the Services;

  • Failure to reduce or stop vaping.

Nothing in these Terms excludes liability for:

  • Death or personal injury caused by negligence;

  • Fraud or fraudulent misrepresentation;

  • Any liability that cannot lawfully be excluded under applicable law.

14. Indemnity

You agree to indemnify and hold harmless Sigh, its directors, officers, employees, and affiliates against any claims, liabilities, losses, damages, and expenses arising from:

  • Your use of the Services;

  • Your breach of these Terms;

  • Your unlawful conduct.

15. Termination

We may suspend or terminate your access to the Services immediately if:

  • You breach these Terms;

  • You misuse the Services;

  • We reasonably believe your use presents a risk to Sigh, other users, or third parties.

Termination does not affect rights or obligations that arose before termination.

16. Changes to These Terms

We may amend these Terms from time to time.

Where changes are material, we will provide reasonable notice through the app, website, or email.

Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from or connected with these Terms.
